			<content:encoded><![CDATA[<p>According to the <span style="text-decoration:underline;">Dallas Morning News</span> Tuesday November 11, 2008 edition home sales were down 17% from a year ago as well as a fall in the median home price to $140,000.  <strong>The good news is there are signs of the market is nearing the bottom</strong> Dr. James Gaines an economist with Texas A&amp;M Real Estate Center said that &#8220;fortunately prices may hold nearly flat, even though home sales continue to decline.&#8221;  Dr. Gaines goes on to mention how <strong>Texas is still one of the best housing markets in the country</strong>.</p>
<p>The even better news is that housing inventory has fallen to the lowest number since January 2006 (at the end of October Dallas had a 6-month supply of homes for sale which shows that the Dallas market has already stablized.  According to the <span style="text-decoration:underline;">Dallas Morning News</span> article <strong>on average, it takes 82 days to sell home here. </strong>The magic number that we would all like to see if 72 days, <strong>but if you price your home correctly and you have staged and taken care of it will sell faster!</strong></p>

<p>Thank you for contacting me regarding down payment assistance programs. I welcome your thoughts and comments on this issue.</p>
<p>Under current law, in order to qualify for FHA-insured home<br />
loans,borrowers are required to contribute a minimum amount to the cost<br />
ofpurchasing the home. Under certain circumstances, the<br />
borrower&#8217;srequired contribution may be paid by other entities.</p>
<p>On July 30, 2008, President Bush signed into law H.R. 3221, theHousing<br />
and Economic Recovery Act of 2008. This comprehensivelegislation<br />
includes a provision, effective October 1, 2008, thatincreases the<br />
borrower&#8217;s required contribution to the cost ofpurchasing a home from<br />
3% to 3.5% and mandates that the borrower&#8217;srequired contribution toward<br />
the purchase of a FHA-insured home may notbe provided by the seller or<br />
by any third party that is beingreimbursed by the seller.</p>
<p>In<br />
response to H.R. 3221, Representative Al Green (D-TX)introduced H.R.<br />
6694, the FHA Seller-Financed Downpayment Reform andRisk-Based Pricing<br />
Authorization Act of 2008.  This legislation wouldamend H.R. 3221 to<br />
provide exceptions to the prohibition on sellercontributions. In<br />
addition, downpayment assistance organizations wouldbe required to<br />
offer financial counseling services to borrowers H.R.6694 passed the<br />
House Financial Services Committee on September 16,2008, and is now<br />
awaiting consideration by the full House ofRepresentatives. No<br />
companion legislation has been introduced in theSenate.</p>

<p><span>* Rebate is available<br />
only to buyers who close escrow/proceed to final settlement by December 31,2008 with Nick Good of<br />
Keller Williams Realty acting as their sole and exclusive agent in the purchase<br />
of real estate. For homes with a final sales price of $100,000.00 or more, the<br />
rebate is twenty percent (20%) of the cooperating broker commission actually<br />
received by Nick Good of Keller Williams Realty at the close of<br />
escrow/settlement for representing the buyer net of any allowances or other<br />
deductions by Keller Williams Realty related to the transaction. Occasionally,<br />
the seller and/or listing broker in a transaction will offer the broker<br />
representing the buyer a bonus or other additional incentive over and above the<br />
cooperating brokerage commission. Any such bonuses or other additional<br />
incentives are separate and apart from the cooperating brokerage commission<br />
actually received by Nick Good of Keller Williams and buyer is not entitled to<br />
a rebate on any bonus or other additional incentive monies paid to Keller<br />
Williams over and above the cooperative broker commission. For homes with a<br />
final sales price of $99,999.99 or less, the rebate is Two Hundred Fifty<br />
Dollars ($250.00). The rebate will be paid or credited to the party or parties<br />
named as the &#8220;buyer(s)&#8221; or &#8220;borrower(s)&#8221; on the HUD-1<br />
Closing Statement or equivalent official closing statement. In the case of an<br />
IRC §1031 Tax Deferred Exchange (&#8220;Exchange&#8221;), the party named as the<br />
&#8220;buyer or borrower&#8221; is the Qualified Intermediary (the &#8220;Exchange<br />
Company&#8221;) and the rebate will be paid or credited to the Exchange Company<br />
for the benefit of the party conducting the exchange (the<br />
&#8220;Exchanger&#8221;). All buyers, or in the case of any Exchange, the<br />
Exchanger must sign a Rebate Agreement before any rebate will be issued. This<br />
rebate program is only available where permitted under state and federal law<br />
and when not otherwise prohibited by the buyer&#8217;s lender(s). The rebate program<br />
is not available in New Jersey.<br />
